TERMS AND CONDITIONS: BECOME A KOALA CHAMPION AND WIN
Become a Koala Champion and win a WWF and Australia Post Merchandise pack Terms and Conditions.
1. Competition Period: The ‘Become a Koala Champion and win a WWF and Australia Post merchandise packs’ (“Promotion”) commences on 12/08/2024 at 9.00 am (AEST) and final entries close at 11.59 pm (AEST) on 13/12/2024 (“Promotional Period”).
2. Promoter & Supplier:
a. The Promoter is World Wide Fund for Nature Australia (WWF-Australia, ABN 57 001 594 074) of Level 3, 45 Clarence St, NSW, 2000 (“Promoter”).
3. Entry Eligibility:
a. Entry is only open to Australian residents aged 18 years or over.
b. Employees and their immediate families of the Promoter and Supplier associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex- spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
c. Incomplete or indecipherable entries will be deemed invalid. Entries automatically generated by computer, completed by third parties other than the Supplier’s service provider in bulk, or that have been altered, reconstructed or tampered with will be rejected.
4. Agreement to Rules:
a. By entering the Competition, the contestant ("You") agree to comply with and abide by these Terms & Conditions and the decisions of the Promoter, and you represent and warrant that you meet the eligibility requirements. Information on how to enter and the prizes form part of these Terms and Conditions.
b. In addition, you agree to accept the Promoter's decisions as final and binding as those decisions relate to the content of this campaign.
5. Collection and use of personal information:
a. Personal Information including the Eligible Entrant’s name, address, telephone number and email will be collected and used for the purpose of conducting this Competition. This may, for this purpose, require disclosure of such information to third parties, including, but not limited to, agents, contractors, service providers, Promotion suppliers and as required, to Australian regulatory authorities. Validity of an entry is conditional on providing this information.
b. Any personal information provided will be handled in accordance with the Promoter’s Privacy Policy, which can be accessed at http://www.wwf.org.au/privacy-policy.
c. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, subject to your explicit consent, for an indefinite period, unless otherwise advised, use your personal information for promotional, fundraising, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning you, in accordance with any applicable Laws.
6. Entry Instructions: To enter, you must undertake the following steps during the Promotional Period:
a. Visit the Promoter’s web page www.wwf.org.au and complete the Koala Champion quiz. Input the requested information including full name, phone number, postcode and email address; and submit the fully completed entry form online. Incomplete or indecipherable entries will be deemed invalid.
b. No fees will be charged for completing the Koala Champion quiz. However, you are responsible for any and all other expenses that may incur in entering or winning the competition.
c. One entry per person is permitted. All entries have equal weighting regardless of quiz scores. Six winners will be drawn based on a game of luck.
d. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
7. Prize Draw Date: The winner will be drawn on 19 December 2024 at 10 am (AEST) at the Promoter’s Sydney Office at Level 3, 45 Clarence St, Sydney NSW by random draw under the supervision of the Promoter.
8. Prize: Six winners will be drawn randomly from all eligible entries received. The winners will receive one of six prize packs valued at a total of AUD $150. It includes:
a. WWF-Australia merchandise pack with a t-shirt, drink bottle, hat and socks.
b. Australia Post and WWF-Australia Koalas In Danger special edition stamps and Pip the Koala plush toy.
c. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
9. Claim the prize:
a. The winners will be notified by 5.30 pm (AEST) on, 19 December 2024 via the email address provided at the time of entry. Their first initial, last name and postcode will be announced and published on WWF-Australia web page https://wwf.org.au/koalachampion/.
b. The winners must claim the first prize by replying to the winner announcement email within two months of the announcement on 19 December 2024.
c. As a condition of accepting the prize, the winner must provide personal information, and sign any legal documentation as and in the form required by the Promoter and/or Supplier in their absolute discretion, including but not limited to a legal release and indemnity form.
d. At the conclusion of the two months, if no response is received by the Promoter, we will deem the prize as unclaimed, and it will be redrawn on 16 November. The winner from the redraw will be notified by email and website (in accordance with clause 10a) and similarly given two months to claim the prize.
e. If by 19 February 2025 there are still unclaimed prizes, the Provider will give notice and seek advice for disposal of prizes.
10. General:
a. The Promoter may withdraw this Promotion or vary the prize amount or otherwise amend these Terms and Conditions at any time.
b. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
c. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to regulations to:
i. to disqualify any entrant; or
ii. to modify, suspend, terminate or cancel the promotion, as appropriate.
11. Liability:
a. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
b. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to:
i. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
ii. any theft, unauthorised access or third-party interference;
iii. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
iv. any variation in prize value to that stated in these Terms and Conditions;
v. any tax liability incurred by a winner or entrant; or
vi. taking and/or use of the prize.
12. Jurisdiction: This agreement is governed by the law in force in the state of New South Wales, Australia.
13. Dispute Resolution: Any dispute arising in connection with these Terms and Conditions or in connection with the Promoter which cannot be resolved by good faith negotiations between the parties shall be referred to mediation or to arbitration. However, the Promoter reserves, at its absolute discretion, the right to instigate legal proceedings prior to negotiation, arbitration or mediation against any individual, organisation or entity, who in the Promoter opinion has acted in breach of these Terms and Conditions.
